Enforcement Cost Calculator
Enforcement costs consist of different items depending on whether the enforcement proceedings are based on a court judgment (ilamlı) or not (ilamsız), and the total amount varies accordingly. An advance fee is charged in proceedings without a judgment, whereas this item does not apply to judgment-based proceedings.
Certain fixed fees and costs are charged when initiating enforcement proceedings with or without a judgment. These amounts are updated every year and sometimes during the year, so knowing the current figures is important for an accurate calculation.
On this page we explain, step by step, the cost items of enforcement proceedings with and without a judgment, the calculation methods and worked examples using current figures. If you would like legal support with your proceedings, you can contact the Bursa Mudanya Law Office team.
How Is the Cost of Enforcement Without a Judgment Calculated?

The cost of enforcement without a judgment is the sum of the filing fee, the power of attorney copy fee, the power of attorney stamp, the advance fee and postage. In 2025, the cost items of enforcement proceedings without a judgment are:
- Filing fee (fixed amount): TRY 615.40
- Power of attorney copy fee (fixed amount): TRY 87.50
- Power of attorney stamp (fixed amount): TRY 138
- Advance fee (five per thousand of the claim)
- Postage (UETS electronic service, standard and express)
The filing fee, power of attorney copy fee and power of attorney stamp are fixed items regardless of the amount or type of the proceedings. These amounts change every year, and sometimes during the year.
How Is the Advance Fee Calculated in Enforcement Without a Judgment?
The advance fee is calculated at five per thousand (0.5%) of the claim and is charged only in proceedings without a judgment. In practice it is easily found by dividing the claim by 200.
The claim amount used for the calculation is the principal plus accrued interest and other ancillary amounts as at the date the proceedings are initiated.
For example, for a claim consisting of TRY 100,000.00 principal and TRY 50,000.00 accrued interest — TRY 150,000.00 in total on the date of enforcement — the advance fee is TRY 750.00.
How Is Postage Calculated in Enforcement Without a Judgment?
Postage depends on the method used to serve the payment order on the debtor. The payment order can be served in four different ways:
- Electronic service (e-tebligat): TRY 15.00
- Service by standard post: TRY 210.00
- Service by express post: TRY 420.00
- Service by public notice (calculated according to the notice text)
Electronic service is used for persons with an electronic service address; payment orders must be sent to the electronic address of publicly held joint stock companies.
Standard and express service are used for persons without an electronic address whose physical or MERNİS address is known. The difference is that express service is delivered by PTT more quickly.
Service by public notice applies when neither an electronic nor a physical address of the debtor can be found. The enforcement office first carries out an address search; if no address is found, the notice is published via the Press Advertising Agency on ilan.gov.tr.
Example: Cost of Enforcement Without a Judgment
The costs of enforcement proceedings without a judgment initiated for a claim of TRY 1,000,000.00 using express service are as follows:
- Filing fee: TRY 615.40
- Power of attorney copy fee: TRY 87.50
- Power of attorney stamp: TRY 138
- Advance fee: TRY 5,000.00
- Postage: TRY 420.00
- Total: TRY 6,260.90
How Is the Cost of Judgment-Based Enforcement Calculated?

The cost of judgment-based enforcement consists of the same filing fee, power of attorney copy fee, power of attorney stamp and postage items; unlike enforcement without a judgment, no advance fee is charged.
Judgment-based proceedings are usually based on a court judgment, and both the claimant and the defendant are represented by counsel. The court decision is therefore served on the debtor's counsel by electronic service, which costs TRY 15.00.
Example: Cost of Judgment-Based Enforcement
The costs of judgment-based enforcement proceedings initiated for a claim of TRY 1,000,000.00 using electronic service are as follows:
- Filing fee: TRY 615.40
- Power of attorney copy fee: TRY 87.50
- Power of attorney stamp: TRY 138
- Postage: TRY 15.00
- Total: TRY 855.90
The filing fee, power of attorney copy fee, power of attorney stamp and postage used in the calculations above are the figures current as of 19/04/2025. These items are fixed amounts independent of the claim and may be updated in line with inflation.
Who Is Responsible for Enforcement Costs?

Enforcement costs are initially paid by the creditor; however, once the proceedings are initiated these costs are added to the claim and are ultimately borne by the debtor.
Can Costs Incurred Before Enforcement Be Added?
Yes. A creditor may add certain documented costs incurred before the enforcement proceedings to the enforcement claim, provided they are clearly stated in the enforcement request. A formal notice sent for an invoice receivable or a protest drawn up for a promissory note are examples of such costs.
Pre-enforcement costs are assessed separately for proceedings with and without a judgment.
In judgment-based proceedings, the court also rules separately on litigation costs, so the costs of the lawsuit can be claimed together with the enforcement. However, costs not covered by the judgment cannot be claimed in judgment-based enforcement.
In proceedings without a judgment, the creditor may add documented costs incurred to collect the receivable to the enforcement claim, and must state these items clearly in the enforcement request.
A protest for non-payment drawn up for a promissory note can be added to the enforcement because it is legally required for collection. For other costs, if the debtor objects to the enforcement, the burden of proof lies with the creditor.
One of the questions our firm is asked most often is whether the attorney's fee can be claimed from the debtor or defendant. The fee paid to your own lawyer is consideration for legal services paid on the client's behalf, so it cannot be claimed from the debtor or defendant.
