An intellectual property lawyer is a legal specialist who secures the legal protection of your ideas, trademarks, inventions and designs — your most valuable assets in today's competitive commercial environment.

Today, the greatest capital of companies and individuals is no longer physical assets but the original projects, software and brand identities they create.

The unauthorised use (copying) by others of a brand you have spent years building or an innovative product you have developed causes irreparable commercial and reputational damage. Intellectual property law is a highly technical field in which strict deadlines, complex opposition procedures and international registration rules are intertwined.

Registration procedures — often thought to involve nothing more than filling in an application form — can easily be cancelled by competitors' oppositions or taken away through invalidity actions if they are not built on a strategic legal foundation.

A single wrong step taken on your own may cause you to lose all legal rights to your unique invention or brand to a competitor.

Working with an experienced intellectual property lawyer is vital for your commercial future, both to prevent your work from being stolen and to protect your legal rights.

At Bursa Mudanya Law Office, our team of specialist copyright lawyers provides professional solutions to protect your creative ideas and works against all kinds of infringement.

What Is Intellectual Property Law?

What Is Intellectual Property Law?

Intellectual property law is a special branch of law that protects intangible assets produced by human intellect and effort.

It is divided into two main branches:

  • Intellectual rights (copyright): cover products requiring creativity, such as literary, artistic, musical and cinematographic works and computer software.
  • Industrial property rights: cover trademarks, patents (inventions), utility models, industrial designs and geographical indications used in commercial and industrial life.

This page covers the protection of the intellectual rights (copyright) created by your business or by you personally, as well as software, digital art and unregistered rights.

Intellectual rights (copyright) protect works of science, literature, music, fine arts, software and cinema produced by human intellect and creativity. In Türkiye, copyright matters are governed by the Law on Intellectual and Artistic Works No. 5846 (FSEK).

Our firm offers the following specific solutions in copyright law:

  • Securing copyright: For general information on the legal scope, duration and methods of protecting your work, see our Copyright guide (in Turkish).
  • Proving authorship: Where there is a dispute about who actually owns a work, it must be determined by the courts. We manage actions for determination of authorship from start to finish on behalf of our clients.
  • Legal action against infringement: Where your works are reproduced or sold without permission or pirated on websites, we meticulously handle notice-and-takedown procedures, access blocking and criminal complaints as part of our Copyright Infringement services.

Infringement and Dispute Resolution

Infringement and Dispute Resolution

The creation of rights is only the first step of protection. The real challenge is actively defending these rights against imitators seeking unfair gain in the digital world or the physical market. Working with an experienced copyright lawyer to follow these processes without error is critical to protecting your rights.

Our firm manages the following proceedings before the Intellectual and Industrial Property Rights Civil Courts:

  • Access blocking (notice and takedown): Where your works are used without permission on digital platforms or websites, we handle formal notices and obtain access-blocking orders. See our Copyright Infringement page (in Turkish) for details.
  • Damages and cessation of infringement: We file actions for material and moral damages to stop the infringement, recall pirated products and compensate your loss. Material damages are calculated taking into account "lost profits" (the likely profit the right holder would have earned had there been no infringement).

Although intellectual rights (copyright) arise automatically, in some cases the names of such works can be used as trademarks. In addition, a distinctive website design or book cover can be protected through design registration.

  • For infringement of your registered trademark, the seizure of counterfeit goods at customs or in the market, and invalidity and unfair competition actions, see our Trademark & Patent Lawyer page.

Conclusion

Intellectual property rights are your most powerful commercial capital: they determine the value of your company and can be transferred, licensed and inherited.

Technical errors in legal proceedings or delayed action against infringement can destroy years of work in an instant.

To turn your ideas into commercial value and build a protective shield around them, you should proceed with specialist legal advice.

Frequently Asked Questions

Common questions about Intellectual Property Lawyer

To qualify as a work, a product must bear the characteristics of its author (originality/personal character) and fall within one of the categories of works listed in the law (science and literature, music, fine arts, cinema). Products meeting these conditions are protected from the moment of creation, without registration.

Under Turkish legislation, computer programs, mobile applications and source code cannot be patented on their own. Software benefits from copyright protection as a "work of science and literature" under the Law on Intellectual and Artistic Works.

Moral rights (the right to make the work public, to be named as author and to prevent alterations to the work) belong exclusively to the author; they cannot be sold or transferred. Economic rights (adaptation, reproduction, distribution, performance and communication to the public) can be assigned to third parties by contract or licensed for use.

Copyright protection lasts for the author's lifetime and for 70 years after their death. Even after the author has died, their heirs may lawfully benefit from the economic rights and income from the work for 70 years.

Sometimes there is no identically copied registered trademark, yet a competitor may imitate your unregistered packaging, advertising slogans or trade presentation and create a misleading impression among consumers. In such cases, governed by the Turkish Commercial Code, these activities can be stopped through an unfair competition action.
