TÜRKPATENT Oppositions & Responses
TÜRKPATENT opposition and response procedures cover filing oppositions against trademark or patent applications and submitting formal responses to oppositions received.
TÜRKPATENT opposition and response procedures are the administrative proceedings conducted during the bulletin publication of trademark or design applications, or against refusal decisions issued by the Turkish Patent and Trademark Office. When a trademark registration is opposed or an application is refused, you need the support of a trademark lawyer.
At Bursa Mudanya Law Office, our lawyers who are also registered trademark attorneys professionally manage all your opposition and response procedures before TÜRKPATENT.
Official TÜRKPATENT Attorney Authorisation and Its Strategic Importance
Administrative oppositions and defences concerning industrial property rights require advanced technical and legal knowledge. A single procedural error can prevent the registration of commercial assets you have spent years building. In addition to their experience as lawyers in trademark and design law, our firm's founders are authorised attorneys registered with TÜRKPATENT:
- Med. Att. & Trademark Attorney Ömer SEFA
- Med. Att. & Trademark Attorney Zeynep KARACA

Our Trademark Opposition and Response Services

We resolve all administrative obstacles and third-party interventions encountered during trademark registration with a strategic approach:
- Oppositions to the Trademark Bulletin: When imitations of or marks similar to your registered trademarks are published in the TÜRKPATENT bulletin, their registration must be prevented. We prepare reasoned oppositions within the statutory period to protect your rights. See our Opposition to the Trademark Bulletin page (in Turkish) for details.
- Responses to Oppositions: Third parties may raise unjustified similarity or bad-faith claims against your application. We prepare strong defences to rebut these claims and save the registration process. See our guide Responding to a Trademark Opposition (in Turkish).
- Reasoned Appeals Against Refusals: Your application may be refused in whole or in part by TÜRKPATENT examiners on absolute or relative grounds. In such cases we file appeals before the Re-examination and Evaluation Board (YİDK) seeking the reversal of the Office's decision. For details, see our pages Appealing a Trademark Refusal and Absolute Grounds for Refusal (in Turkish).
Design Refusal, Acceptance and Opposition Procedures

As with trademarks, design registration is subject to strict administrative review and opposition mechanisms:
- Design Bulletin Oppositions and Responses: We exercise our right to file official oppositions in the bulletin to prevent the registration of designs that lack novelty or individual character or have already been made available to the public. We also prepare technical defences against unjustified oppositions to your designs.
- Appeals Against Design Refusals: TÜRKPATENT may refuse ex officio designs that are not new or are contrary to public order. Against such administrative refusals, we apply to YİDK with reasoned appeal files demonstrating the originality and technical differences of the design.
Conclusion
A note on infringement and litigation: If the final administrative decisions issued by YİDK are unfavourable, an action must be filed before the Intellectual and Industrial Property Rights Civil Court to annul them. For detailed information on our litigation services, see our Trademark & Patent Lawyer page.
Common questions about TÜRKPATENT Oppositions & Responses
The periods are strictly set by law according to the type of dispute. Oppositions to trademark applications must be filed within 2 months of the bulletin publication date. For bulletin oppositions against design applications, the statutory period is 3 months.
Submitting a response to an opposition is not a legal requirement. However, remaining silent on unjustified claims significantly increases the risk that the TÜRKPATENT examiner will refuse your application. Submitting a strong counter-statement is vital to defend your rights.
No. You have the right to appeal partial or full refusal decisions to the Re-examination and Evaluation Board (YİDK), the highest authority within the Office. The Board re-examines the examiner's decision and issues the final administrative decision.
TÜRKPATENT may refuse ex officio designs that lack worldwide novelty or individual character. Designs contrary to public order or morality, or containing religious symbols, are also barred from registration and refused.
Proceedings before the Office are based entirely on legal precedent, provisions of the Industrial Property Law and technical similarity analyses. Generic statements are usually rejected. Working with registered trademark and patent attorneys ensures that sound arguments are presented correctly and increases the likelihood of success.
